TERMS OF USE

1. DEFINITIONS

1. "the ECTA" the Electronic Communications and Transactions Act No. 25 of 2002;

2. "the site" this site and any other site owned by T 4 W;

3. "T 4 W" Thirst for Work CC;

4. "user" any person making use of, posting, or volunteering personal information on this site;

2. AGREEMENT

The use of this site by the user is governed by the terms contained herein.

3. ACKNOWLEDGEMENT

3.1 The user acknowledges that the submission of personal information as contemplated in the ECTA to T 4 W is entirely voluntary, that personal information published by T 4 W will be made available and disclosed to client of T 4 W and once such personal information is in the hands of clients,
T 4 W cannot reasonably exercise control over or guarantee the use to which that personal information is put.

3.2 By registering or uploading personal information of a user on the site, T 4 W does not guarantee employment of the user nor that T 4 W or its clients will consider the user for employment opportunities which may exist or will exist in the future.

3.3 T 4 W subscribes to the principles of Section 51 of the ECTA.

4. INDEMNITY

Subject to Sections 43(5) and 43(6) of the ECTA the user accordingly indemnifies and holds T 4 W harmless against any claim whatsoever including loss, damage, penalties or fines arising from the inability to use or the failure to use the user’s personal information published by T 4 W by any person.

5. WARRANTY

The user warrants in favour of T 4 W and any of its customers that the information submitted by a user is true and correct and indemnifies T 4 W against any claim arising from or related to loss or damage suffered by a third party as a result of incorrect personal information submitted by a user.

6. CONSENT

Without derogating from the acknowledgement in 3:

6.1 The user specifically consents to the use of its personal information and where submitted in a representative capacity warrants that it is duly authorised to submit such personal information and is in possession of the necessary consent such that:

6.1.1 T 4 W may disclose such personal information to third parties;

6.1.2 T 4 W and its clients may use and publish such personal information to advertise job candidates, match job candidates with job offers and otherwise use such information in the ordinary course of their business.

6.2 The user indemnifies T 4 W against any claim arising from the publishing of personal information submitted by the user without the consent of a third party to whom the personal information relates.

7. SECURITY OF INFORMATION

7.1 All reasonable steps will be taken to secure users’ personal information from access by persons other than clients of T 4 W and in terms of service agreements with them.

7.2 Where applicable, the user undertakes not to divulge its user name and password to any other person.

7.3 It is prohibited for any person to gain unauthorised access to any page on this site or to deliver or attempt to deliver any unauthorised, damaging or maliciously code to this site. Any person so doing shall be liable for any loss suffered by T 4 W which shall include loss of profits calculated by way of a reasonable estimate.

8. DISCLAIMER

Subject to the provisions of Sections 43(5) and 43(6) of the ECTA:

8.1 T 4 W does not warrant the correctness or completeness of any job offer by a third party and the user indemnifies T 4 W against any claim or loss whatsoever arising from or related to an invitation, offer by a third party or agreement between a third party and a user, notwithstanding that such offer, invitation or agreement was concluded or induced as a result of the use by a third party or a user of the site.

8.2 T 4 W shall not be liable for any damage, loss or liability of whatsoever nature arising from the use or inability to use or view this site or the services and content provided from and through this site.

8.3 T 4 W makes no representations or warranties, implied or otherwise that, amongst others, the content and technology available from this site or via a link to a third party website are free from errors or omissions or that the service will be 100% uninterrupted and error free.

8.4 The site is supplied on an "as is" basis and has not been compiled to the users’ individual requirements. It is the sole responsibility of the user to satisfy itself prior to entering this agreement with T 4 W that the services available from and through this site or via a link to a third party website will meet the users’ requirements and be compatible with the users’ hardware/software.

8.5 Information, ideas or opinions expresses on this site should not be regarded as professional advice or the official opinion of T 4 W.

9. COPYRIGHT
1. T 4 W is the owner and/or publisher of all text, graphics, advertising or formatting appearing on this site which may not be reproduced in any form without the written permission of T 4 W.
2. T 4 W retains the copyright in databases of personal information including personal information submitted by the users.
3. To the extent that any information submitted by the user contains intellectual property owned by a third party then the user grants T 4 W a worldwide, transferrable, sub-licencable, non-exclusive licence to use such intellectual property.

10. AMENDMENT, VARIATION OR DELETION OF PERSONAL INFORMATION

10.1 The user shall be solely responsible for any editing or amendment to personal information submitted by the user.

10.2 T 4 W reserves the right to remove any personal information from the site for any reason whatsoever and in its sole discretion without any necessity to provide reasons therefore.

11. SEVERABILITY

Each separate element of this agreement shall be severable from the balance of the agreement which shall continue to be of effect in the event that any part of this agreement is found contrary to law.

12. WHOLE AGREEMENT

This is the sole agreement between the parties on this subject. No preceding representation, offer, design, specification, invitation or trading conditions proposed or settled upon shall be of any effect whatsoever save to the extent that it is recorded in this agreement.

13. GOVERNING LAW
1. This agreement shall be governed by and interpreted in accordance with the law of the Republic of South Africa.
2. Any dispute or claim arising from this agreement shall be heard and resolved in the High Court of South Africa, the parties hereby consenting to its jurisdiction.
